These Terms and Conditions (“Agreement”) are entered into by and between Imaj Photo, hereinafter referred to as “Photographer,” and the client or their representative, hereinafter referred to as “Client,” collectively referred to as the “Parties.”
1. Photography Services
Photographer agrees to provide wedding photography services to the Client as described in the agreed-upon package or scope of work.
The Parties will collaborate to determine the specific services and expectations for the photography session, including locations, timing, and style.
The Client agrees to pay the agreed-upon fees for photography services as specified in the contract.
Payments may be made in installments as outlined in the contract. The full payment must be received by the due date specified in the contract.
3. Cancellation and Rescheduling
In the event of a cancellation, the Client may be subject to a cancellation fee as specified in the contract.
Rescheduling of photography sessions must be agreed upon in advance and are subject to Photographer’s availability.
4. Photography Rights and Ownership
The Photographer retains the copyright to all photographs taken during the session, including the right to use them for promotional and portfolio purposes unless otherwise agreed upon.
The Client may use the photographs for personal use but may not sell or publish them without written consent from the Photographer.
5. Photo Delivery
The Photographer will provide the edited photographs to the Client within the timeframe specified in the contract. Delivery times may vary depending on the number of photographs and post-processing requirements.
The Photographer is not responsible for any injuries, damages, or loss of property that may occur during the photography session.
The Client is responsible for the behavior and safety of all subjects during the photography session.
7. Image Editing
The Photographer will use professional judgment in selecting photographs for editing and delivering the final images.
Any additional editing or retouching services may be subject to additional charges as agreed upon.
8. Privacy and Model Release
The Client grants the Photographer permission to use the photographs and likenesses of all subjects in the photographs for promotional and portfolio purposes unless otherwise specified in writing.
9. Dispute Resolution
In the event of a dispute, the Parties agree to resolve it through mediation, negotiation, or arbitration, as specified in local regulations.
10. Governing Law
This Agreement shall be governed by the laws of [Your Jurisdiction], and any legal actions shall be filed in the appropriate jurisdiction.
11. Entire Agreement
This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements or understandings, whether written or oral.
